Terms of Service

The short version:CarPool helps small groups of families coordinate carpools. Use it for that, treat other families respectfully, and don't try to break or abuse it. We'll do our best to keep it running, but we don't make guarantees. You can stop using CarPool anytime — and we can stop providing it to you if you misuse it.

1. Agreement

These Terms of Service ("Terms") are between you and CarPool ("CarPool", "we", "us"). By creating a CarPool account or otherwise using the CarPool website and application at carpool.family(the "Service"), you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use CarPool.

2. What CarPool is

CarPool is a private coordination tool for a small group of families to plan who drives the kids — set up activities, assign drivers, and chat about each event. CarPool does not provide transportation, match strangers, screen drivers, or guarantee that anyone will show up to drive. Carpool arrangements are entirely between the participating families.

3. Your account

  • You must be at least 18 years old, or the legal age of majority where you live, to create a CarPool account.
  • Provide accurate information when you sign up, and keep it up to date.
  • You're responsible for keeping your password and Google account secure, and for anything that happens under your account. Tell us at carpool-app@googlegroups.com if you think your account has been used without permission.
  • One account per family. Don't create accounts for someone else without their permission.

4. Carpool groups and content

  • When you create or join a carpool group, the other families in that group can see the events, schedules, and messages you share with the group. Don't share anything with a group you wouldn't want the other families in that group to see.
  • You keep ownership of the content you create on CarPool (event details, messages, photos, etc.). By posting it to a group, you give CarPool a limited license to store, display, and transmit that content so we can show it to the other families in your group. This license ends when you delete the content or your account, except for backups and content others in the group have already received.
  • Don't post content that doesn't belong to you, that infringes someone else's rights, or that contains other people's personal information without their permission.

5. Acceptable use

Don't use CarPool to:

  • Harass, threaten, bully, or impersonate anyone — including other parents in your group.
  • Post content that is unlawful, hateful, sexually explicit, violent, or otherwise harmful.
  • Coordinate carpools involving children that the children's parents have not authorized.
  • Send spam, run promotions, or use CarPool for commercial solicitation.
  • Scrape, copy, or otherwise extract CarPool data outside of normal use of the Service.
  • Probe, attack, or otherwise interfere with CarPool's systems, security, or other users' accounts.
  • Use CarPool to break any law, or to violate anyone else's rights.

6. Children

CarPool is for adult caregivers. Children under 13 may not create CarPool accounts. As a parent or guardian, you may enter your own children's first names into your family profile and add them to events — see our Privacy Policyfor what we collect and don't collect about children.

7. Privacy

Our Privacy Policy explains what information CarPool collects, why, and how we protect it. By using CarPool, you also agree to that policy.

8. Pricing and Founding Families

CarPool is currently free for everyone. We've announced a Founding Families offer: the first 10 carpool groups to sign up will keep CarPool free for life, even after we introduce paid plans for later groups. Until we explicitly confirm a particular group as a Founding Family in writing, the offer is a promise about future pricing, not a contract. We reserve the right to adjust the terms of paid plans we introduce later for non-founding groups.

9. Service availability and changes

We work to keep CarPool running smoothly, but we don't promise it will always be available, error-free, or feature-stable. We may add, change, or remove features at any time, take parts of the Service offline for maintenance, or discontinue CarPool entirely with reasonable notice.

10. Ending your account

  • You can leave anytime.Use "Leave group" in the app to leave your carpool group, and email carpool-app@googlegroups.com to delete your account.
  • We can suspend or terminateyour account if you violate these Terms, if your account is used to harm other users or the Service, or if we're required to by law. When that happens, we'll generally try to give you notice and a chance to resolve the issue first, except in urgent or legal situations.

11. CarPool's rights to its own materials

The CarPool name, logo, website design, software, and other materials we create are owned by us and protected by intellectual property laws. These Terms don't give you any rights to use the CarPool brand outside of normal use of the Service.

12. Disclaimers — no warranty

CarPool is provided "as is" and "as available."To the fullest extent allowed by law, we disclaim all warranties — express, implied, or statutory — including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that CarPool will be uninterrupted, secure, or error-free, that information in the app is accurate or up-to-date, or that any particular driver will show up for a given carpool. Carpool arrangements are between you and the other families; CarPool is not responsible for whether anyone drives, is on time, or drives safely.

13. Limitation of liability

To the fullest extent allowed by law, CarPool will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or related to your use of CarPool. Our total liability for any claim arising out of or related to these Terms or CarPool will not exceed the greater of (a) the amount you paid CarPool in the 12 months before the event giving rise to the claim, or (b) US $50.

14. Indemnification

You agree to defend, indemnify, and hold CarPool harmless from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of CarPool, your content, or your violation of these Terms or applicable law.

15. Changes to these Terms

We may update these Terms from time to time. When we do, we'll change the "Last updated" date at the top of the page, and for material changes we'll give you reasonable notice — for example, a banner in the app or a note by email. If you keep using CarPool after a change takes effect, you accept the updated Terms.

16. Governing law

These Terms are governed by the laws of the United States and the State of Montana, without regard to conflict-of-law principles. The federal and state courts located in Montana will have exclusive jurisdiction over any dispute that isn't required by law to be resolved elsewhere. If you live in a country whose laws guarantee you additional consumer protections, those protections still apply.

17. Miscellaneous

  • If a court finds any part of these Terms unenforceable, the rest still applies.
  • Our not enforcing a right doesn't waive it.
  • You can't transfer your CarPool account or these Terms to someone else without our permission. We may transfer them, for example as part of a sale or reorganization of CarPool.
  • These Terms and the Privacy Policy are the entire agreement between you and CarPool about the Service.
